Contents

Background

It was enacted because it was discovered that the Housing Corporation had been delegating its statutory functions without lawful authority for 40 years. [4] [5] Its purpose was to retroactively legalise this. [6] [7]

Provisions

The act gives the Housing Corporation a power of delegation either to staff or a committee of the board with retrospective effect. [8]

The Housing Corporation is also deemed to have always had this power. [8]

Section 1 - Power of Housing Corporation to delegate functions etc.

Section 1(1) inserted paragraph 6A of Schedule 6 to the Housing Associations Act 1985. It was repealed [9] for England and Wales [10] on 1 April 2009. [11]

Sections 1(2) to (4) read:

(2) The Housing Corporation is to be taken to have been authorised, at all times before the passing of this Act, to delegate the exercise of any of its functions to any of its members, committees, sub-committees or employees; and Housing for Wales is to be taken to have been so authorised at all times before its abolition.

(3) Anything which purports to have been done before the passing of this Act by the Housing Corporation or Housing for Wales is to be taken to have been validly done if done or evidenced by a document duly executed under its seal.

(4) If the fixing of the seal of the Housing Corporation or Housing for Wales has, at any time before the passing of this Act, been authenticated by the signature of any of its members or employees it is to be regarded as having been properly authenticated. [12]

Section 2

Section 2(1) authorises the citation of this Act by a short title and section 2(2) provides its extent.
